The current NBA CBA negotiations demonstrate the role of public opinion in negotiations involving owners of professional sports franchises and players. Both sides have talked tough publicly. The NBA owners chose the legal system, to draw lines in the sand.

One big point of contention in the current labor dispute— guaranteed contracts, will prove to be a big sticking point. If we accept public opinion as a major influence, then Orlando Magic guard Gilbert Arenas has surely single-handedly ensured guaranteed contracts will not be part of any new NBA CBA.

Derek Fisher will sit down in front of NBA owners and state that guaranteed contracts will be a non-negotiable issue. David Stern and the NBA owners will hand Fisher a copy of Arenas’ Twitter activity. Derek Fisher will take a glance, and make the call to players letting them know that guaranteed contracts will no longer be a perk of playing in the NBA.
